Penguin Magic problem

Penguin Magic problem

I'm not sure if anyone else has these and can check, but I have a few bonus effects from Sankey products I purchased in the past from Penguing. Among them are shufflecutdeal and Belly of the Beast. I hadn't used Belly of the Beast in a while, so I thought I'd check out the instructional vid that came with it, but lo and behold - it's gone.

I know way back when, Penguin pulled the bonus instant downloads - but did it also mean they pulled the downloads from people who already bought the effects?

Just wondering if anyone else noticed this.

I'll check on mine later as I have one Sankey download from Penguin.

If you've paid for it then I don't think that they can legally remove it.

I've just received an email from Penguin saying the following:

- As part of the unfortunate actions taken by Jay Sankey and Sankey Magic towards Pengiun Magic, they have used their co-ownership of the copyright for all of the Sankey Magic instructional videos to deny us legal permission to host the videos on our servers. -


Now I saw where Sankey was coming from in some regards, and I think Penguin had a few good points in their counter-argument. However, I'm starting to lean towards the tuxedo wearers a bit here.

It's one thing to pull your products off the shelves. However, I already PAID for the products that came with these instructional videos. Don't I have some kind of rights in this situation?

I respect Jay Sankey, but this may be something to bear in mind when I contemplate future purchases.

I see no reason why they couldn't just continue to host the videos. They could just stop selling them. This sounds really unfair...

Sorry to hear that this is happening ... only further fuels my dislike for penguin, thier business ethics are very poor.

If you contact Jay then I'm sure he would be happy to share a copy of the video with you.

Dislike for Penguin? Jay Sankey is the one who had the videos pulled! Penguin is trying to get the videos back on the server.

Erm, I wouldn't trust Penguin too much when they say things like this as they have shown quite a bit of liberty with the truth on their previous statements (e.g. when they claimed that the reason that they didn't stock Anytime Anywhere was because the DVD case was bad...).

Correct me if I'm wrong though...

You might snigger at poor cases as a reason, but if the DVD arrives all scratched then it's ruined and unusable. I think it's a fair point.

I have a feeling you're right. It feels like they're pulling all content and telling us its Sankey making them do it. It appears that Sankey's denying you access to your purchases. From the wording, it seems he's the one in the wrong. Problem is, people know he's a nice guy having talked to him. The very fact that people feel they can email him asking to help them out says a lot. I'm inclined to think that pulling the videos didn't actually come from Sankey, though I'm not sure why... I keep looking at the wording of the statement, but I can't put my finger on what feels wrong about it.
