Postby midge25 » Aug 6th, '08, 10:58

any ebay experts here?

i have a 100% feedback on ebay never had any problems.

I recently sold an item, to a fairly new ebayer, now they have sent a message saying they dont want it as it is not new and want a refund.

the description was very clear, the picture was clear too, that it was not new and had been used.

my questioon is am i obliged to give a refund just because they dont want it?

tricky ground that, and it keeps on shifting.

I would imagine that it would be worth refunding the cash, to keep your score 100%.

Im sure that Ebay has some info on this, if you do a search, because its probably a very common problem.

yes, i see your point, but i am just annoyed about it really, and am considering losing my 100% record on this as a matter of principle.

Hello.
if you item was fairly listed and did not state it was new, you are not obliged to give a refund.
Ebay and paypal have dispute consoles that work through issues with buyers etc.
Was the item a buy it now or auction.
If its an auction what i would do, is get the buyer to post back. Issue refund (although not for pnp) and offer to the last highest bidder.

Ebay have a fantastic ommunity on there like a forum where people are really helpful and will reply almost staright away to your problem.

Hope this helps,

Forgot to add.

Prevention is better than cure, so if you sell regularly a refund policy is always a good idea.
NOthing much just items are listed fairly, refunds only given if faulty etc etc.

If it was clearly marked as used/not new, you're certainly not obliged to give a refund. But it depends on whether you think they are taking the mickey and just getting it and going "er, hmm... nah, I don't want it" or whether it was a genuine oversight on their behalf and they are honestly upset and frustrated that they hadn't seen the "used" status.

If the latter, I personally would refund them if they return the item to you at their own expense, and obviously refund the amount minus your postage and packing charges - I can't quite remember the details on this but I think eBay should let you relist it for free. Otherwise you could remove insertion fees/final sale fees from the amount too.

And I'd labour how great this makes you and how you are willing to go out of YOUR way to help them rectify THEIR mistake :?

Edit: also, if it's a magical item, forget it. And as FairieSnuff says, it's worth having a refund policy - mine's along the line of "only if the item differs from the description", and given that I write the description, that ain't gonna happen!

yes it was fairly described, and was nit stated as new.

it was a pad that records digital notes, the picture was quite clear it had been used it showed writing on the pad and all the box bitsetc laid out on my carpet, so how they claim they thought it was new i dont know.

as for offering it as second chance the secobd person has now got one.

at the moment my thought is one black mark wont do any harm especially when i am in the right.

i am a very laid back person but this has really got me argh!!

Assuming your listing was accurate in it's description of the product, and the product was "fit for purpose" based on that description, then legally you are not obliged to give a refund. Morally it's up to you. Depending on the price and circumstances, perhaps you may want to consider a partial refund less your costs?

I know how you feel - it's a total drag to finally offload something successfully via eBay, then be faced with the proposition of going through the selling process all over again.

What you could do is explain that it was clearly marked as used, opened etc. and that whilst you're sorry he was disappointed, it's really not your fault - you could then suggest that to save postage and packing costs, he simply sells it on, because that's what you're going to have to do. You could even offer to email him the photograph and the details.

I hate it when people don't know how things work and then blame you :x

In a word: no.

If it was exactly as described then the buyer is an idiot.

Well, if the guy ignored the description in favour of what he wanted it to say, it's his own fault he's disappointed with his purchase. eBay have also changed the rules so that he's not allowed to take it out on the seller by leaving negative feedback.

Dunno about the name for people from Cheshire, but I'm certainly a proud Maxonian, born and bred (strong in the arm and weak in the head!) :D

If they give you negative feedback - you can have it removed by ebay ! So that black mark mightnot even stick. Thats why its worth opening up a dispute case now.
