Great post guys and thanks for the links and clarities.

However, magic being the art it is, and it being as old as it is... Don't you think something definite would have been sorted out by now? For both the dealers and the buyers?

It's the gray area of magic at the moment and pretty silly when you think about it!

I don''t think anything definite ever gets sorted out, in any form of society. There is always crime, war, unjust laws, morally grey business practice and reality T.V. No matter how many times the same mistakes get made we always repeat them.

Invoke not reason. In the end it is too small a deity.

I've responded to this before so I won't again. And not to defend any postition, I'm not sure where you are from but I know that in Canada and the USA under 'consumer law' you do not have the right to return or demand a refund in a specific amount of time. If a product is damaged you have that right. Store policy dictates what it will take back and in what period of time and for what reason (except in the case of damaged goods). and that must be written on the bill of sale. Further if there is nothing of that respect written on the bill of sale then the rule of thumb is that you bought it, you own it.

The issue with magic is in most cases the product will do what it says, usually not in the way you may want it to or perhaps it won't work in your particular venue. But most of the time, by hook or by crook it will do what it says.

Solution, find a magic dealer you like build a relationship with that magic dealer and usually they won't steer you wrong.

All can be summed up as: 'Let the buyer beware'. Suppliers only have legal repsonsibilities when products are faulty, any other time it depends on how you approach and negotiate the problem. Better still, before you buy ask what the returns policy is and that way you can decide whether or not to deal with that supplier.
