Warning about WAND Magic Shop

Normally I am against naming and shaming Magic Shops as I like to give them the benifit of the doubt if possible, however as I feel I should give everyone a warning.

I ordered a DVD from them way back in July and simply put it still hasn't arrived. At one point the owner James Green did send a Banachek DVD which I sent straight back as apart from not ordering it, I already had it. (I wish I had kept it now).

For the last 3 weeks I haven't heard from him AT ALL. Emails are not answered, Phone messages are not replied to. In short he has fallen off the face of the world.

Now I have just checked his site again, as I was considering what legal action I could take, and I notice the site is no longer there.

If I lived closer to Buckhurst Hill, Essex I would visit him personally but as it is my options are very limited.

I don't want this thread to turn into a slagging of area for Wand magic, but I do think that if you have recently ordered from them you should at least beware of it.

If anyone has had a similar problem withWand Magic, maybe we should get together to see what we can collectively do (feel free to pm).

My next course of action will be worldpay/Trading Standards.

and if anyone lives near Buckhurst hill, and wouldnt mind doing me a favour (no violence I promise) then I would appreciate you getting in touch.

I too order a DVD from them in August and it still hasn't arrived (again no email or phone calls returned).

I must admit that I wish I had got it from somewhere else as I wanted the DVD I ordered in September so I could start practicing some stuff for my wedding in November (I'm going to do some table hopping..)

I too have so far refrained from making accusations etc.. but now I know it's not just me !

The phone number shown on their paperwork (0208 928 1111) is unobtainable as well. Claim refunds from the credit card companies - sharpish!

Funny..

I just contacted my credit card company five minutes ago..

Looks like it could be a long winded process.. but hey.. 25 quid is 25 quid !

You will definately get your money back. I have a merchant account, and they just notify you when someone has put a complaint aginst a transaction (mine were all fraud transactions) and take the money out of your account.

Wand whont be able to hold back the money.

I hope so, although I suspect that Wand doesn't have money any more. I will keep you informed on the progress of my claim. I am still tempted to pop around to the guys house...

you can pick me up on the way, as i have sent him bits and pieces for my stuntman effect as he said he would sell it for me, and, guess what, no reply!

I believe he was using the RBS Merchant Worldpay. Most merchants hold the money for 4 weeks before releasing it. this is done for this particular reason and fraud transactions. So they way it works, when you first open an account you don’t get any money until the fifth week, and that would be the transactions made in the first wee, so the 6th week will be the transactions in the 2nd week ETC.

I’m not sure how long Wand has been down for, hopefully money will still be in the account. Anyhow, the bank will catch up with him, so their is nothing to worry about. Hopefully

I even used a spell checker :D

... I did'nt mean you dude, its just that I ordered a DVD from another company, they said they will send it, they did'nt, its now out of stock, but I am still waiting for a credit note or refund. (about 3 months now!!!)

Credit card companies will do their very best to tie you up in the hope that you will give up on a refund. However, when you use your card to purchase and item from a vendor and money is deducted from your card and paid to the vendor (deemed to have been paid when it is shown as a transaction on your balance irrespective of whether or not is has actually been paid to the vendor), the law deems that BOTH the vendor and the credit card company have entered into a contract with you to supply the goods that you have ordered and paid for. If the vendor fails to supply then the credit card company is liable on behalf of the vendor to honour the contract, in this case provide a refund.

Under certain circumstances you can also claim damages for failure to supply goods that have been ordered.
