Just a quickie if I may...

I have just discovered Mini key-ring Mr sharpies.

Now, I had always noticed that Sharpies were very difficult to get a hold of in my neck of the woods until quite recently. This is because, I am informed, the Sharpie company have started to sponsor a programme on the telly which is very popular. Some American thing or other, I'm not too sure what.
Mind you, since I have not had a telly now for over seven years I'm very unlikely to find out. Anyway..

The upside of this is that they are now being sold everywhere up here, up in the Arctic circle where I live.

I digress. The point? 'The Stationary Box' has a deal. 70p each if I remember, all colours.

This is the first time I have seen these, and I love them. Not only do they have a special ring for your key-chain, but they have a special safety device that means that the cap will not pull off in your pocket as you walk around.
I do love gadgets.

Cool, i got a load of retractable sharpies the other day.

Didnt cost anything

I got a voucher from Staples - which said £10 off with every £10 spend.

So i went to Staples to got the pens, and they had 2 prices for them same code just different prices.
1) 4 x pens - £3.29
2) 4 x pens - 6.99

i got 4 packs and took them to the counter and was told they were 6.99, the manager was called and confirmed that the price was wrong and seeing as 'the right thing' to do (also legal thing!) would be to sell them at the lowest price.

I then paid using the £10 off Voucher so got £28 worth of pens for £3.

Then yesterday in the post i got sent ANOTHER £10 VOUCHER, happy days

trading standards say's that they have to sell the pen to me at the same price within 7 days or with draw them from sell for 48 hours before they can increase the price.

So more free pens for me.

It’s my understanding that any retailer does NOT have to sell any item at the marked price.
The price is an offer and when you take it to the counter it is up to the seller to accept or decline the offer.
As for price changes you can change them all you like with no restrictions.

Of course this is dependent on whether or not you are actively using this method to con customers, but this is hard to proveand as long as your advertising of the item is not misleading.

Your right he could have refused to sell me the item - but then he must remove it from sell for a period of 48 hours. This stops price fixing.

Because he had agreed i can buy them at the lower price, as on the recipt. If i go back and prove that they were at a lower price within their trading agreement which is 7 days, agian they will sell at the lower price.

The law is allows for mistakes on pricing, which is why you have to remove the product from the shelf for a time period, although the general rule is the price you see is the price you pay.

If anyone cares enough to know, the price displayed on an item merely serves as what is known as an "invitation to treat", which means an invitiation to go and make an offer on the product or service. This offer must then be accepted to form part of a full and binding contract.


As Darren has mentioned, there are now additional safety nets in place to stop misuse of this.
