Criminal record

Postby Le Petit Bateleur » Mar 2nd, '10, 22:05

Do you guys and girls know how I can get an extract of my criminal record? I lived in the UK 9 years, and I would like to provide evidence I didn't get into any troubles while I was there, i.e. that my record is empty.

I just received a copy of my French one, will get a copy of my Czech one this week, but I'm not sure how to proceed with the administration in the UK.

Thanks.

You need to go to a police station to do this and complete a data protection form that entitles you to a print out of what is currently on the police computer database.

There is a cost of £10 and it can take up to ten weeks although most of the time it's a lot quicker.

As far as I am aware this is the only method of doing this.

Ahah. It sucks then, because GBP 10 is nothing compared to the cost of the plane ticket I will need to get there...

You mention the police. I will check the home office web-site then, and see if I have any luck there.

Thanks Dat.

YOu could get a basic disclosure from disclosure scotland. Check what that gives you.

You could apply to work for a nanny agency and get them to do an enhanced disclosure for you and to supply you with the details.

You might do one of the child protection things, but I don't have any experience of that.

Note that DS will only ever give you stuff that they are permitted to disclose. Anything that might prejudice a prosecution or is otherwise regarded as sensitive would not appear on your DS check.

The DPA and FOI excludes anything that is "sensitive". You also need to think about other police forces as the police are a federated bunch and while you might get a PNC check you won't get anything that other forces have about you.

Bear in mind that employment of a person with a criminal record is a risk management decision and as such a "CRB" check is more than just a list of your convictions but a review against the threat profile for the specific post. Unfortunately, some organisations don't do this and just have a deny-all rule.

Not necessarily true as a subject access disclosure deals specifically with convictions that are unspent and all police stations have the same access for this. Only criminal intelligence is held regionally which is not disclosable on a subject access request.

The police Federation is a membership for officers that is to do with their welfare and is nothing to do with disclosures etc.

Any organisation has the legal right to have an employment risk policy that specifically excludes people with criminal convictions that are unspent, irrespective of how minor the conviction was and how long ago it occurred. That's their right whether you like it or not.

The Home Office is the right place to begin your search. Good luck

If you are not living in England, why would you want a copy of your record?
I have never been to Nigeria, so I know I have a clean record there. But it's completely irrelevant.

Er.... Tony, maybe I should have mentioned this before but I got an email from someone in Nigeria about using my bank to deposit a whole heap of cash (seemed like quite a good deal at the time...)

Anyhow, I gave them your details and then, unfortunately, it all went a bit wrong - so your Nigerian record might not be quite as clean as you thought...

Sorry...
