How do I find a will?

Postby storm01 » Dec 2nd, '11, 19:28

Twenty years ago my parents made a will. They thought no more of it until recently and now realise they would like to amend it. The problem being, the solicitor who dealt with things has since passed away and my parents now have no idea who is holding their will. I am sure I am right in thinking that as long as the old will is revoked(shredded), then they can go ahead and make a new one stating the old will is void.I guess a trip to the local solicitor will probably be the right choice but knowing solicitors as I do it is sometimes difficult to find one who has your best interest at heart. Any help would be greatly appreciated

As far as I know (though I'm not a lawyer, so you shouldn't take my advice!), any new will superceeds any older version; the older version doesn't need destroying/shreddingif it has been mislaid, for the new will to take precidence.

I'm fairly certain that, if you searched or asked on the Consumer Group Forums (http://www.consumeractiongroup.co.uk/forum/), you'd have definitive confirmation of this very quiuckly :D

I agree with old Rob.

Just tell them to have an inclusion of the words 'this will supersedes all made before it' or words to that effect.

I may have been born yesterday but I stayed up all night.

Oi!

Less of the 'old', thank you - young whippersnapper.

As a compromise, I may accept 'distinguished' at a push

The usual wording in wills starts with something like:

    Last Will and Testament

This is the last Will and Testament of me (Full Name) born on (Date of birth) of (full address) made this ________ day of _______________ 20__. I hereby revoke all former Wills and Codicils mad by me and declare this to be my last Will.

If there's an earlier will it's automatically invalidated by a new one.

By the way, if someone remarries then any earlier wills they made are also invalid and a new one should be made as soon as possible otherwise it can get very complicated!
