Promotional DVD help

Postby stitchie18 » Jan 16th, '06, 01:05

Hiya me and Dan are recording a promotional DVD (30th Jan 2006)
We have all our slogans ready and a run through of what were are performing.
The only thing we need is the music!!
We wanted to use the terminator 2 music (from the bit where is is getting melted at the end by john connor).
I have heard alot of stuff about copyright laws.
Would we be able to use this for our DVD?
If not any suggestions of where to find music, or how to get permission?
Thank you, Richard

You would need to get permission to use the music.

One way to get music is to get a band to let you use their music. There are loads of unsigned bands who play excellent music and could provide you with a great track.

Have a look at the busking video on http://joejoeonline.com he got the music off a band

All you have to do is find some people who play the music you need. Credit them on your promo and you both get the benefit.

Stichie18,
No you cant use this music as you are correct that you would be in material breach of copyright law. Take a look at http://www.talkmagic.co.uk/ftopic6925.php for details.

There is however plenty of music available to you. Try going to http://www.creativecommons.org and try their search facility. You may also want to search google using the term podsafe. Once you have found a piece of music that you want to use then email the copyright holder, and request their permission as a courtesy.

Good luck with your search.

You would also be wise to get a formal agreement with the band that you can use their music in this way. The great thing about creative commons and other similar communities is that the agreement is already in place.

EDIT: One more thing, if you decide to use a creative commons licenced work, or similar, check to see that you have rights to use in a commercial product. Some of the licences limit you to non-commercial derived works. Same goes for podsafe music.

Again, good luck in your search.

hmnmm.... i just looked at your site and saw the stuff that you guys perform to people. it just occured to me that if you use other peoples stuff (tricks by Jay sankey and etc), dont you have to ask them for permission? that might cause alot of copyright problems.

?!~

For crying out loud, the msn button under my name is to talk about magic with me, NOT A FREE MAGIC GIVEAWAY LINK. dont abuse it

I dont think performance is an issue, so long as you credit people ... if you are divulging the secrets then its rocky ground.

Heres a relevant quote from another thread on copyright. Forgive me for self quotation.

pdjamez wrote:Be very careful when performing other peoples routines though. If I pick up the instructions from the ID and publically perform them, I am technically in breach of copyright law. This is called a transformation; in other words if I take copyright material in one media and move it to another the original copyright owners rights still apply.

Did you now that when you perform your ID routine your in breach of copyright? Actually your not, thats why I used the term technically. It can clearly be argued that the instructions convey the right to perform the routine publically. This may not be so clear cut if I perform them on a DVD and sell it though.

Feel free to look at this thread http://www.talkmagic.co.uk/ftopic6925-60-0-asc-.php, but only if you feel masochistic.

Not really relevant, I'm afraid. Just convention between magicians.

I think you're fine using the Trick Stichie ... provided this is a Tuition DVD ... if its just performance then its no problem atall.

Although you should probably credit them at the end .. just to say thanks.

Hmm yeah but I wouldn't thank 'Eddie Gibson' for my coin unique...

Just imagine the credits..

Dodgy coins...................'Eddie Gibson'

Surely if someone sells you a magic trick then they are expecting you to use it?
