I've performed this trick loadsa times and I've never been caught out.
The way I present this trick is as follows:
I shuffle the deck then I ask the spectator to clear their mind and start thinking of red and black and to form a sequence of red, red, black, red ... etc. Whilst they are doing this I reckon on that I'm picking up vibes from them and proceed to set up the deck in front of them. Whilst I'm setting up, I make sure that the spec is constantly forming red and black images in their mind. Occasionally I'll stop and do a bit of play acting such as telling the spec to think only of red and black as other images in their mind are clouding my vision etc
When I'm sorting the cards into 2 piles, I always take the card off the top of the deck before I place it onto whichever pile the spec chooses - the amount of times people have "explained" the trick by saying that when they chose red I took a red card from the top of the deck and when they chose black I took a black card from the bottom of the deck. So I always stress that the card comes from the top of the deck and I always place it onto their selected pile using no devious sleights
