My ebay dilemma

I think he should complain regardless. The guy's trading stolen goods regardless of whether he says he is or not.

You are not allowed to sell copies on ebay. When you sell something, you have to agree that the goods you are selling are not counterfeit.
The description didn't say they were copies, and the guy has a 100% positive feedback, so I didn't suspect anything.

Not yet, I'm considering the best form of attack. Should email him, or ebay? Do I send the items back to him for a refund even though they are copies, and so he can then sell them again? Or just leave bad feedback warning people, hope he doesn't do the same to me, and leave it as a lesson learned?

The guy's re-selling the same DVD over and over again and making a mint.
