theres been some discussion about this on youtube actually, looking through the terms of service there, by uploading a video to youtube, you are automatically granting permission for that video to be used by any other member within the sites functionality... which means...
youtube doesnt have downloading videos as part of the site... so thats not allowed even tho it is possible.
what is allowed is linking to, embedding and adding to your faves list etc aslong as you are a member of youtube yourself.
yeah theres alot of copyrighted material on there... which they wont have permission to upload BUT, when they upload it, they check a little box saying it isnt copyrighted material, us little people have no choice but to accept that they may actually have permission to use it. its down to the original copyright owner to say otherwise... no one else can get a video removed for copyright violation.
Obviously the TM rules say no exposure... so any vids, copyrighted or not, showing that arnt allowed on the site - but aslong as it isnt exposure... you can legally link to and embed any video on youtube here, they give you permission to do that when they sign up - aslong as your a member of youtube )
