Most firms will have insurance cover for loss in transit but as there are usually minimum values involved, small packets and so on may not be worth making a claim for. The Post Office/Royal Mail usually have get-out clauses for ordinary post but if a premium service is used then a claim is possible. We've only done this a couple of times at work and they always paid up - eventually.

A former Contract Lawyer friend of mine states that the contract is between you and the retailer and if the retailer subscontracts the delivery then it's the retailers responsibility to sort out the fact that it's not arrived.

Nope, I disagree.

Even if it's 'lawful' to expect the retailer to 'catch the ball', it's not how it works in the real world.

The retailer passes the contract to the courier. It is then the courier's job to get the goods to you.

I don't care about lawyers etc. writing silly clauses or rules: MY job is to sell the goods to the customer. THE COURIER'S job is to deliver them. That is the contract. And if they don't fulfil it, they haven't performed their job, and they will be liable.

Standard Parcels

For Standard Parcels the ‘due date of delivery’ is the third working day after it was posted. 90% of parcels arrive within three working days, but if yours doesn’t, the information below will tell you how we can help.

Has your parcel arrived seven or more working days after it was posted?
If so, your mail is classed as ‘delayed’, and we’ll give you compensation of 12 First Class stamps. If you provide additional evidence of delay and your claim for compensation is accepted, you will be sent a cheque for £5, or for £10 if your item has suffered substantial delay (i.e. was delivered more than thirteen working days after the day of posting and you provide additional evidence or proof of delay.

What happens if your mail is lost?
If your mail gets lost, we’ll give you a minimum compensation of 12 First Class stamps. However, if there was something of value in your mail, we'll refund the actual loss, up to a maximum of £32 or up to the market value, whichever is the smaller amount. Please apply for this within 12 months.

Please note that we do not pay compensation without an original certificate of posting being produced.

It got even better. The band were great, and I ended up being chatted up by a rather attractive female ex-ballet dancer. Very touchy feely, very nice.

Migraine this week though... that's quite a green and slimy thing.

oooh i've always wanted to date a dancer...ya lucky devil...ex-ballet dancer...my sordid mind is racing and i dare not post the images in my mind...my one's an architect...plenty of room for innuendo there...

This may be the case abraxus, but it is still the retailer who chose top subcontract the to the post office and it's thus up to them to sort it out.

Im soooo green and slimey. I've just had my close up case stolen from the back of my car :evil: Stupidly I keep most of my stuff in there as well. I've got a meeting with a chap about some regular gigs creeping up on me too. All I have now is half a deck of bikes and half a bag of elastic bands (which I can busk with, but won't be my best performance, and I'm skint so can't afford new stuff!). Might cut up my dressing gown cord and try fiber optics with it!! :roll: And worst of the worst to top it all off I had just been given back my signed copy of Art of Astonishment DVD Which I stupidly stupidly lent out to a magician friend!! :oops: :evil: :evil:

I'm pre-empting a green and slimey morning tomorrow, i've got two leaving do's to go to today..though thankfully im only working at one of them, and can get pleasantly wasted at the second one..

and i've been promised a nice cohiba cigar too... :)

nah, defo green n slimey - i predict a heavy head tomorrow, i intend on staying out late tonight and see what mischief i can get into...

cocktails...thats the burden of working in central london, too many places with nice cocktails and happy hours, and not enough time to go to all of them...its a nice burden to have tho...

though im breaking in my new esp mini-act today at the first leaving-do, only the third time for a small audience...kinda nervy, kinda excited...bought a spare pair of pants with me...

man-flu is the worst thing, women just dont understand do they...man-flu is ten times worse than a period obviously...try telling a woman that and they'll throw a knife at you...
